 TERMS and CONDITIONS

By choosing Earth-Star Tours as your preferred transport provider, all bookings are subject to terms and conditions as set out below. When booking with us, you are agreeing to the following:

Booking with Earth-Star Tours

To enable us to book your tour, we will require pick-up locations. In addition to this we will need to know how many passengers are from your party/group in this location. Earth-Star tours may charge a pick-up and drop off fee. It will be charged for each  location only if it is more than 7(seven) kilometres outside of the Adelaide CBD in South Australia and outside of 7(seven) kilometres of The Babinda district in Queensland. The fee will be calculated at $2 per kilometre. This fee can be paid upon booking your tour or paid at the time of pick-up to the office or your driver.

Quotations and Rates

Prices are set upon delivering you to your outlined destinations in your chosen tour(s). Prices are valid for 30 (thirty) days and are inclusive of GST, exclude tolls, parking charges and credit card fees. If relevant, these additional fees will be charged directly to your credit card supplied. All bookings are calculated in Australian dollars. Any special equipment needed e.g. Baby capsule or child seats are not included, and you will be required to organise and purchase separately to your booking. 

Payments

All bookings are to be paid in advance and upon booking. A valid credit card is to be provided (even if you are paying by EFT, Electronic transfer using bank account details, or cash).

Payment methods

Earth-Star Tours accepts payment via the following methods and if applicable the service charges are shown alongside.

Visa 2%  Mastercard 2%  Amex 3%

Direct Deposit and PayPal attract no charges.

 

Amendments to bookings

If you wish to make any changes to your confirmed booking, these can be accepted subject to availability. Earth-Star Tours reserves the right to charge any additional fees in relation to the amendments,

Cancellation Fees

Should our driver be on their way or is waiting at the agreed location when we are advised of the cancellation this will be charged in full.

If we are advised of the cancellation with:

Less than 2 hours’ notice or- 100% of total fare cost will be charged.

Between 2 hours and 12 hours- 75% of total fare cost will be charged.

More than 12 hours but less than 24 hours- 50% of total fare cost will be charged.

More than 24 hours’ notice- No fee charged

Transporting Minors and Special Needs Persons

A minor is considered a person under the age of full legal responsibility and in South Australia and Queensland is a person under 18 years of age. As all our drivers have police clearances with DHS and WWCH we are able to transport children, vulnerable people with special needs.

Passengers who are aged 11(eleven) years or under, must be accompanied by either a parent or guardian, the only exception is if prior to transport there has been an agreement confirming the collection and drop off point and advising the details of the adult releasing and collecting the child. Before we can release the minor, we ask the collecting adult to show proof of identity which may include our driver taking photos of identification.

Children up to 6 months

  • Must use an approved rear facing restraint.

  • Must not travel in the front seat of a vehicle.

Children 6 months up to 4 years

  • Must use either an approved forward- facing child safety seat or a booster with an inbuilt harness (depending on their size), with a properly fastened and adjusted lap-sash belt.

  • Must not travel in the front seat of the vehicle, unless all the other seats are occupied by children who are under 7 years of age.

Children 7 years up to 16 years

  • Must use a seat belt that is properly fastened.

Service Dogs ONLY

  • Must be seated in the front by the passenger on the floor.

  • Any soilage incidences will be the responsibility of the owner to pay the sanitation fee of $850 which will be charged against the card details supplied at the time of booking.

 

Damage to the vehicle

The client and /or passengers being transported assume(s) full financial liability for any damage to the vehicle caused during the trip be it by the client or any member of the client’s party. (This does not include damage due to a motor vehicle accident).

 

Liabilty

Earth-Star Tours and/or contractors are not liable in the event of a mechanical breakdown while on hire nor are we responsible for any delays or termination of journey caused by motor vehicle accidents, road works, delayed flights, etc and will work with you to arrange alternative transport.

In the event the client or any member of the client’s party causes damage to the vehicle, the client will be financially responsible to repair the damage within a short period of time from the incident occurring.

 

Harassment

Should any of our drivers, co-workers, contractors, clients or any other person participating on the trip provided by Earth-Star Tours feel threatened or harassed in any way, they will be encouraged to report the incident to the South Australian or Queensland Police Department.

The driver may at their own discretion ask the individual(s) to disembark from the vehicle at any time and if need be, may drive to a police station for their own safety.

Harassment is classified as any verbal or physical conduct designed to threaten, intimidate, or coerce an individual including both sexual and verbal harassment. Sexual harassment includes unsolicited and unwelcomed sexual advances, requests for sexual acts, or other verbal or physical conduct of a sexual nature. Verbal harassment includes comments that are offensive or unwelcome regarding a person’s national origin, race, colour, religion, age, sex, sexual orientation, pregnancy, appearance, disability, gender including slurs and negative stereotyping.

 

Lost Property

Earth-Star Tours are not responsible for any lost, missing or damaged items in the vehicles; however we will do our best to locate and return your goods to you at a mutually agreed time and date. Should we need to make a special trip for you this will be added to your invoice. Alternatively, if we are unable to agree on a time and date and location, we will leave the items at our nearest police station for the client to collect.

 

Requested to leave the vehicle

Should any of our drivers observe behaviour associated with excessive alcohol consumption in any of its’ passengers, they may refuse their right of a return trip, ask them to stop drinking or provide them with a sick bag for their use if required. Smoking and/or vaping is not permitted in the vehicle. If the individual(s) in question is part of the group, it will be up to the other travellers as to whether they continue their trip with us and if they choose not to proceed with us there will be no refund. Should this be the case it will be up to the individual/group to make their own way from the point they had left the vehicle.

NB: Sanitation fee for all vehicles is $850 ( eight hundred and fifty dollars) per incident 

 

Pick up times

Earth-Star Tours cannot guarantee the availability of a booked car/driver beyond the original booked pick-up time. Earth-Star Tours provides 5(five) minutes extra wait time and will endeavour to contact you if you have not yet arrived. Your chauffeur driver will wait a further 5(five) minutes before considering the booking “a no show.” The client is required to contact us by phone if extra waiting time is required and our driver will consider the extra wait time and decide if it is feasible to do so. It may incur an extra wait time fee.

Extra  time Fees

$1.00 per minute after complimentary 5 minute grace period. Up to 30 minutes,

$2.00 per minute after 30 minutes and up to 1 hour inclusive

$3.00 per minute after 1 hour has passed.

Public Holidays the wait time fees double.

We cannot be held accountable for any delays. It is up to the client to ensure adequate time has been allowed when making the booking.

 

Amendments to bookings

Should you wish to amend your tour pick-up time we will do our best to fulfill this for you but may not be able to do so if it clashes with other clients’ bookings. Our office or driver will advise if this is the case and whether we can come to an agreed alternative pick-up time. The same applies to pick-up locations. We will need at least 2 hours’ notice to attempt to alter any pick-up times and/or locations. 

Amendments to pick-up and/or drop off locations

Earth-Star Tours will endeavour to work with the client to adjust any pick-up locations. However, we may not be able to delay the tour if the pick-up/drop off location requires more time and distance to administer. It will be determined by our office or driver if this is a feasible detour. Any extra time to allow for this adjustment may incur a fee as stated in extra time fees. Extra distance travelled will also incur a fee. This will be calculated at $2 per kilometre.

 

Consuming food and beverage inside the vehicle(s)

Passengers are not permitted to drink or eat in the vehicle. However, water is permitted to be consumed in the vehicle.

Restraints

Seatbelts are required by law to be worn by every passenger of every vehicle that you and/or your groups are transported in. If we are pulled over by the police and someone is fined for wearing a restraint the total cost of the fines will be charged against the credit card supplied. This includes the cost of a fine if the driver is penalised for the passenger’s ignorance.

 

Seating capacity and use of seats

Vehicles cannot be loaded beyond seating capacity. Luggage, prams, and other accessories are restricted to the boot capacity only. Those which do not fit in the boot will not be placed in the vehicle under any circumstances. In this instance it is up to the client to organize an alternative means to transport their items and arrange payment for this.

 

Mobile refrigeration in boot

Earth-Star Tours endeavours to supply a small refrigeration unit in the boot space of the vehicle. This allows each client to pack a small area only to allow for a light snack and lunch with a drink to be consumed at our chosen lunch spot. We will supply name tags and bags for you to easily identify your items. We will not enter into any disagreements regarding who owns which items.
